judge, former airport commissioner, pulled into Freedom of Information query

- The Unalienable Rights Foundation (UARF) has filed a Freedom of Information
request with Newport News Circuit Court Judge H. Vincent Conway Jr. in an
attempt to determine why the Peninsula Airport Commission (PAC) is operating
illegally. (See: UARF
was a member of the prestigious Peninsula law
firm of Jones, Blechman,
Woltz, & Kelly before being appointed to the bench. He was also a member of
the PAC before going on the circuit court bench. His previous law firm's
partner, the late Herbert V. Kelly Sr., was the airport's legal adviser when
Conway was a member of the PAC.
David Lindsey, a noted legal researcher, is president of UARF. He
also is president of Helpcom.net, an Internet news organization.
Helpcom.net filed 13 FOIA suits against current airport officials, its
counsel, Herbert V. Kelly Jr., and Mabel Washington, Newport News City
The cases are set for a hearing at 10 a.m., May 3 in Virginia
Beach General District Court.

could be a member of the PAC and allow the commission to operate illegally
according to state law. UARF claims that since 1989, the PAC is to be comprised
of 2 members of each municipality - Newport News and Hampton.
to date, the commission is made up of four members from Newport News and only
two from Hampton. UARF wants to determine how, with two members from such a
prestigious law firm involved with governing the PAC, the state law was ignored.
UARF points out in its FOIA that the March 20, 1989 Acts of the General Assembly
provides, "The Peninsula Airport Commission, hereinafter referred to as the
"Commission," shall consist of two members from each of the
participating counties and cities, appointed by the governing bodies thereof,
UARF request continues, "Newport News' city council was appointing four
members [of which you were one] to serve as commissioners thus exceeding its
quota of appointments by two commissioners.

the law firm advising PAC. It appears to me that there was a lack of economy,
for how else could one explain PAC seating four commissioners from Newport
News," the UARF query notes.
